On 18 December 2024, the Law Commission published its long-awaited scoping report assessing the reform options for the laws governing finances on divorce and the ending of a civil partnership.  The research that underpinned the report highlighted a concerning statistic - in 2023 only around 40% of divorcing couples made applications for financial remedy orders.  Thus, 60% of divorcing couples were left financially exposed because without a financial remedy order, each party may still be able to make financial claims against their former spouse.
