There is a case being assessed by the House of Lords at present, which could have serious implications for the financial services industry and the recognition of human rights.
While the case in question is not directly related to the finance sector, closer inspection of the emergency anti-terrorism laws introduced in 2001 by the Labour government will analyse whether or not Article 5 of the European Convention on human rights has been breached. Whatever the decision of the law lords, the ramifications could impact the financial services sector because this decision will dictate how seriously European human rights law is treated and adhered to.
