Judge says high-profile case will not stop pensions liberation

The current High Court case regarding pensions liberation does not have the scope to end the practice, a Chancery Division judge has warned.

Mr Justice Morgan is presiding over the High Court hearing looking at the extent of The Pensions Regulator's powers to deal with liberation fraud. The judge has been asked by two independent trustee firms - Dalriada Trustees and Pi Consulting - to establish whether the schemes are occupational pension schemes by law and therefore legitimate transfer vehicles (PP Online, 15 July). The hearing was expedited following raids and arrests of persons suspected of conspiracy to defraud and money laundering in May 2013 (PP Online, 9 May).
