A bankrupt who lost a High Court battle over whether he should hand over his pension to creditors will appeal the decision this autumn.
A judge ruled earlier this year that bankrupts who are entitled to a pension which has not yet been drawn may be forced to withdraw the cash to pay off creditors in the case Raithatha v Williamson. Michael Williamson will have his challenge to the decision heard in London between 3 September and 2 November this year. In the original case, the judge ruled that as Williamson had reached retirement age, his pension should technically be seen as income and made subject to creditors' demands, even though he had not begun to draw on the pot.
